Agreement to Terms
By accessing dameandheart.com or purchasing any product or service from Dame and Heart LLC you agree to be bound by these Terms and Conditions. If you do not agree please do not use our website or purchase our products or services. These terms apply to all visitors, users, and customers.
Who We Are
Dame and Heart LLC is a Colorado limited liability company founded by Susan Hay, providing brand and business mentorship, coaching, and digital products. Our principal place of business is Fort Collins, Colorado.
Our Products and Services
We offer the following categories of products and services through our website and through Kajabi.
Free resources including the Revenue Autopsy diagnostic tool, delivered digitally upon email opt-in.
Digital tools including Lumis and the Monday Expander, delivered as AI-powered tools accessible through third-party platforms.
Digital courses and mini programs, delivered through Kajabi upon purchase.
Group mentorship programs, delivered live and on demand through Kajabi on a cohort basis.
Private one-on-one mentorship, offered by application only and governed by a separate client agreement signed at the time of enrollment.
VIP strategy sessions, delivered via video call and governed by a separate client agreement signed at the time of booking.
In-person retreats, subject to a separate retreat agreement and liability waiver signed prior to attendance.
Payment
All prices are listed and charged in United States Dollars. Payment is processed securely by Kajabi. Dame and Heart LLC does not store your payment information. We reserve the right to change our pricing at any time. Price changes will not affect purchases already completed.
Refund and Cancellation Policy
All digital products and digital tools are non-refundable. All sales are final at the point of purchase. This applies to the Revenue Autopsy, Lumis, the Monday Expander, and all digital courses and mini programs.
Group mentorship programs are non-refundable once enrolled. If you cancel more than 7 days before a program begins you will receive a credit toward a future cohort. No credits or refunds are issued within 7 days of program commencement or after the program has begun. If Dame and Heart cancels a cohort you will receive a full refund or credit at your choice.
VIP strategy sessions and private mentorship are non-refundable as outlined in your signed client agreement. Rescheduling of VIP sessions is permitted with a minimum of 7 days notice. One reschedule is permitted per booking.
Slingshot Sessions are non-refundable once booked. One reschedule is permitted with a minimum of 48 hours notice. No reschedule or credit is available within 48 hours of the scheduled session time.
In-person retreats are non-refundable within 60 days of the event date. Cancellations received more than 60 days before the event date will receive a credit toward a future retreat. Transfers to another attendee are permitted with written approval from Dame and Heart LLC. If Dame and Heart cancels an event a full refund will be issued within 14 days.
AI Tool Disclosure
Lumis and the Monday Expander are AI-powered tools built on third-party platforms operated by Anthropic and OpenAI. Dame and Heart LLC is not affiliated with, endorsed by, or sponsored by Anthropic or OpenAI.
When you use these tools you are entering information into a third-party AI platform. Dame and Heart LLC does not control how those platforms process, store, or use the information you enter. Outputs from these tools may vary between platforms and over time as the underlying AI models are updated. You are responsible for applying your own judgment to every output generated by these tools.
Dame and Heart LLC cannot guarantee identical results across different platforms or control how either AI model interprets prompts over time.
Intellectual Property
All content on dameandheart.com and within our products and programs is the property of Dame and Heart LLC. This includes but is not limited to the Brand Influence Codex methodology, the Sphere of Influence framework, the Lumis persona and system, the Monday Expander system, all course and program materials, written content, video content, podcast content, and brand assets.
When you purchase a digital product or program you receive a single-user personal license to use the materials for your own business purposes only. This license does not permit you to reproduce, share, resell, distribute, or create derivative works from any Dame and Heart materials. Unauthorized use of our intellectual property may result in legal action.
Disclaimer of Guarantees
Dame and Heart LLC does not guarantee any specific outcome, income, revenue, or business result from the use of our products, tools, or services. Results vary based on individual effort, experience, market conditions, and many other factors outside our control. Any testimonials or examples shared on our website or in our marketing represent individual experiences and are not typical or guaranteed results.
Susan Hay is a business and brand strategist. She is not an attorney, therapist, financial advisor, accountant, or any other licensed or registered professional. Nothing in our products, programs, or communications constitutes professional legal, financial, therapeutic, or medical advice.
Limitation of Liability
To the maximum extent permitted by law, Dame and Heart LLC's liability to you for any claim arising from your use of our website, products, or services is limited to the amount you paid for the specific product or service giving rise to the claim. Dame and Heart LLC is not liable for any indirect, incidental, consequential, or punitive damages.
Indemnification
You agree to indemnify and hold harmless Dame and Heart LLC, its officers, directors, employees, contractors, and assigns from any claims, damages, losses, and expenses including reasonable legal fees arising from your use of our website or services, your violation of these terms, or your violation of any third-party rights.
Dispute Resolution
Any dispute arising from these terms or your use of our products or services will be resolved by binding arbitration before a single mutually agreed-upon arbitrator under the rules of the American Arbitration Association. Arbitration will be held in Colorado. Each party bears its own costs. The arbitrator may not award punitive damages. The decision of the arbitrator is final and binding and may be entered as a judgment in any Colorado court.
Governing Law
These Terms and Conditions are governed by the laws of the State of Colorado without regard to its conflict of law provisions.
Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. When we do we will update the date at the top of this page. Continued use of our website after any changes constitutes your acceptance of the updated terms.
